Terms of Service

1. Acceptance of Terms

By accessing or using PCMonitor (the "Service"), operated by Imazyn ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

If you do not agree to these Terms, you may not use the Service.

2. Description of Service

PCMonitor is a team productivity monitoring platform that provides:

• A background agent installed on employee computers to track application usage
• A web-based dashboard for managers to view team activity
• AI-generated daily summaries of employee activity
• Optional screenshot capture at configurable intervals
• Activity reports, data export, and team management tools

3. Account Registration and Administration

• You must provide accurate and complete information when setting up your account
• The admin account holder is responsible for all activity under that account
• You are responsible for keeping your admin password secure
• You must notify us immediately of any unauthorised access to your account
• One admin account per organisation. Sub-admin access is managed within the dashboard

4. Employer Obligations

Organisations deploying PCMonitor to monitor employees must:

• Disclose monitoring to employees. You must inform employees that activity monitoring software is installed on their work computers, what data is collected, and how it is used. The PCMonitor setup wizard facilitates this disclosure, but your organisation remains legally responsible for compliance with applicable employment and privacy laws.
• Obtain required consent. In jurisdictions where employee monitoring requires consent, you are responsible for ensuring proper consent is obtained before deploying the agent. PCMonitor's built-in consent step is a tool to assist you — it does not substitute for legal advice or jurisdiction-specific requirements.
• Use monitoring lawfully. You may only use PCMonitor on company-owned devices or personal devices where the employee has given informed consent and applicable law permits monitoring.
• Comply with local laws. Labour laws, privacy regulations (GDPR, PDPB, CCPA, etc.), and employment agreements vary by jurisdiction. You are solely responsible for ensuring your use of PCMonitor complies with all applicable laws in your country and state.
• Maintain a workplace monitoring policy. We recommend having a written monitoring policy that is distributed to all employees before deployment.

5. Acceptable Use

You agree NOT to:

• Monitor individuals without their knowledge or required consent
• Deploy PCMonitor on personal devices that the organisation does not own or control without explicit consent
• Use monitoring data to harass, discriminate against, or unlawfully discipline employees
• Attempt to reverse-engineer, modify, or create derivative works of the Service
• Share, resell, or sublicense access to the Service without written permission
• Use the Service to store, transmit, or process illegal content
• Attempt to gain unauthorised access to other organisations' data
• Use automated tools to scrape or extract data from the dashboard beyond normal use
• Circumvent any security or authentication measures

6. Subscription and Payment

• Free trial. All plans include a 14-day free trial. No credit card required during trial.
• Billing. Subscriptions are billed monthly per seat. Seats are counted as the number of active team members in your dashboard.
• Changes to seats. Adding seats takes effect immediately (pro-rated). Removing seats takes effect at the next billing cycle.
• Payment failure. If payment fails, we will attempt to charge again after 3 days. After 7 days of non-payment, the account is suspended. Data is retained for 30 days after suspension, then permanently deleted.
• No refunds. Subscription fees are non-refundable except where required by law or at our sole discretion.
• Price changes. We will give 30 days' notice before changing subscription prices. Your continued use after notice constitutes acceptance.

7. Data Ownership

• Your data is yours. All activity data collected from your team belongs to your organisation. We do not claim any ownership over it.
• Data export. You can export your data at any time in CSV format via the dashboard. This right survives account termination for 30 days.
• Data deletion on cancellation. Upon account termination or request, all organisation data is permanently deleted within 30 days.
• Anonymised analytics. We may use anonymised, aggregated, non-identifiable usage statistics (e.g., "X% of sessions are idle time") to improve the Service. Individual or organisation-level data is never used.

8. Service Availability and SLA

• We target 99.5% monthly uptime for the dashboard and API
• Planned maintenance will be announced at least 24 hours in advance
• The agent stores data locally and retries on reconnection — brief server outages do not cause data loss
• We do not guarantee uninterrupted or error-free service

9. Intellectual Property

PCMonitor, its source code, design, trademarks, and all associated intellectual property are owned by Imazyn. These Terms do not grant you any rights to use our intellectual property except as necessary to use the Service as described herein.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that results obtained will be accurate or reliable.

11. Limitation of Liability

To the maximum extent permitted by law, Imazyn's total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

We are not liable for: indirect, incidental, or consequential damages; loss of profits or revenue; data loss; employment disputes arising from your use of monitoring data; or any damages arising from your failure to comply with applicable employment or privacy laws.

12. Indemnification

You agree to indemnify and hold harmless Imazyn and its officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from: your use of the Service; your violation of these Terms; your violation of any law or regulation (including employment and privacy laws); or disputes with your employees arising from your monitoring practices.

13. Termination

• By you: You may cancel your subscription at any time from the dashboard. Access continues until the end of the current billing period.
• By us: We may suspend or terminate your account immediately for violation of these Terms, non-payment, or illegal use. We will provide notice unless the violation is severe.
• Effect of termination: Upon termination, your access ends and data is scheduled for deletion after 30 days.

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India. If you are located outside India, you consent to this jurisdiction.

15. Changes to Terms

We may update these Terms periodically. Material changes will be communicated by email to the account admin at least 14 days before taking effect. Your continued use after that date constitutes acceptance of the new Terms.
